The second lawsuit challenging the district’s controversial 24/7 policy was filed in less than two months, as another Haddonfield family filed a federal class action lawsuit Friday.
Mathew Wolf of Pappas and Wolf, LLC., filed the complaint on behalf of the parents of a juvenile within the school district who “was subjected to discipline under the Haddonfield
Board of Education Policy 5132, also known as ‘the 24/7 policy.’”
“Our goal is to vindicate the rights of the families in the school district who have been wronged under the illegal 24/7 policy. The 24/7 policy does not take into account the relationship between the off-campus conduct and school discipline, as required by law. This is illegal and unconstitutional,” he said in a statement. “We expect several counsel experienced in class action lawsuits to join us as counsel for the Plaintiffs within the next few days.”
The lawsuit states that the 24/7 policy violates several constitutional rights of the juveniles who were subjected to consequences.
Under the lawsuit, plaintiffs are seeking – among other things – damages, counsel fees, and restraining the Haddonfield School District from enforcing its 24/7 policy in the future.
“This is a long term project that will take years to resolve,” Wolf said.
He could not go into detail as to what the juvenile did to be subjected to the 24/7 policy.
